1. Agreement & Contract Formation

1.1. These Terms & Conditions (“Terms”) govern your participation in the Total Solar Eclipse Event 2026 organized by Starscapes Experiences Private Limited (“Organizer”, “we”, “us”).
1.2. By making a booking and paying any part of the tour cost, you (“Participant”, “you”) agree to be bound by these Terms. A confirmed booking constitutes a contract between you and the Organizer.

2. Bookings & Payments

2.1. Bookings must be made through the official Starscapes website or authorized channels.
2.2. A non-refundable booking amount is required at the time of reservation as specified on the itinerary page.
2.3. Full payment must be received by the due date communicated at the time of booking, failing which the Organizer reserves the right to cancel the reservation without refund.
2.4. Prices are based on prevailing taxes and exchange rates. Any increase in government levies, supplier surcharges, or currency fluctuations up to the date of final payment may be passed on to the participant.

3. Inclusions & Exclusions

3.1. Inclusions (as listed on the itinerary) typically cover accommodation, specified meals, local transfers, guided tours, entry fees, eclipse viewing sessions, and expert commentary.
3.2. Exclusions typically include international flights, visa fees, travel insurance, personal expenses, optional activities not listed in the itinerary, gratuities, and items of a personal nature.

4. Travel Documents & Insurance

4.1. It is the Participant’s responsibility to hold valid travel documents (passport, visa, etc.) and comply with all entry requirements of foreign destinations.
4.2. Comprehensive travel insurance including coverage for trip cancellation, medical expenses, evacuation, and personal belongings is mandatory and must be purchased by you before commencement of the tour.

5. Cancellation & Refund Policy

5.1. Any cancellation must be notified in writing and is effective from the date of receipt by the Organizer.
5.2. Refunds (if any) are subject to the timeline and conditions specified at the time of booking. Typically:

• Cancellations made by June 30, 2026 — eligible for partial/full refund as advertised at booking.
  
  
• Cancellations after June 30, 2026 — no refund.
  5.3. No shows or unused services are non-refundable.
  5.4. The Organizer reserves the right to cancel the tour due to low enrollment, safety concerns, or force majeure; in such cases, a refund or alternative arrangement will be offered at the Organizer’s discretion.
  

6. Weather & Eclipse Visibility

6.1. Eclipse visibility is inherently weather-dependent. While the Organizer selects optimal locations and timing, no guarantee can be made regarding weather conditions or viewing quality.
6.2. No refunds will be issued for poor visibility due to cloud cover, rain, or atmospheric conditions.

7. Changes to Itinerary

7.1. The Organizer reserves the right to alter or modify the itinerary due to local conditions, safety issues, or operational requirements.
7.2. Substantive changes will be communicated promptly, and reasonable alternatives will be offered where feasible.

8. Participant Conduct & Safety

8.1. Participants are expected to behave responsibly and follow instructions from the Organizer, guides, and local authorities.
8.2. The use of certified solar eclipse viewing glasses and safe observational practices are mandatory during eclipse phases. The Organizer is not liable for any injury or damage caused by failure to follow safety instructions.

9. Limitation of Liability

9.1. To the fullest extent permitted by law, the Organizer and its agents are not liable for indirect, incidental, consequential, or punitive damages arising out of your participation in the tour.
9.2. The Organizer’s liability for direct loss shall be limited to the value of the tour price paid by the Participant.

10. Privacy & Data Protection

10.1. Personal data collected for the booking process will be used in accordance with our Privacy Policy and applicable laws.
10.2. By booking, you consent to the use and storage of your information for operational and marketing purposes as described in the Privacy Policy.

11. Governing Law & Dispute Resolution

11.1. These Terms are governed by the laws of India.
11.2. Any dispute arising out of or in connection with these Terms will be settled amicably in good faith; unresolved disputes shall be subject to the exclusive jurisdiction of courts in India.
